Fish & Richardson Announces Mayo/Myriad Life Sciences Tracker

Fish & Richardson today announced that it has launched a new Mayo/Myriad Life Sciences Tracker online resource designed to help its intellectual property clients stay informed and up to date on significant decisions in which the patent eligibility of life science claims is addressed under Mayo or Myriad

All of the cases in the Mayo/Myriad Life Sciences Tracker database can be filtered by date, court, judge, exception category, status and the issue of “significantly more.” The summaries can be searched by keyword as well. The tracker is also available on Fish’s mobile On-the-Go app, which can be downloaded for both iOS and Android devices. Access to both the online database and the mobile app is free.

“The tracker provides a single source of sampled cases that is updated regularly,” said Ian Lodovice, a principal at the firm who helped develop the Mayo/Myriad Life Sciences Tracker. “Although the tracker does not include every decision related to Mayo or Myriad, we strive to capture the most relevant informative decisions and post new decisions as they are published.”

Mayo and Myriad are each landmark rulings that disrupted long-standing judicial and U.S. Patent and Trademark Office precedent and significantly changed the landscape for obtaining and enforcing patents in the life sciences industry. Under Mayo and Myriad, claims to both diagnostic methods per se and isolated genes that occur naturally in cells are unpatentable under 35 U.S.C. § 101.
