Pierce Davis & Perritano (PDP) attorneys Michael D. Leedberg, Joel F. Pierce and Alexandra Nassopoulos Vilella recently obtained a defense verdict in a three-week asbestos liability trial in Connecticut. 

PDP’s client, a manufacturer of asbestos-containing printed-circuit board, was sued by the estate of a man who died from mesothelioma and lived 2 ½ miles from the manufacturing plant. The plaintiff alleged that he contracted mesothelioma claiming asbestos fibers were released into the environment from the manufacturing plant. PDP was successfully able to demonstrate to the jury that their client’s operations did not cause the plaintiff’s mesothelioma.

After several weeks of jury selection, three weeks of trial, and nearly five hours of deliberations, the jury returned a verdict in favor of PDP’s client. 

This is a significant victory for PDP’s client and for the asbestos defense bar generally, as plaintiffs’ counsel are continually seeking new theories of liability, and “fiber drift” or neighborhood exposure cases are in the forefront. 

The plaintiff called experts Barry Castleman, David Christiani, and David Mitchell; experts Christy Barlow and Paul Scott (both of ChemRisk) and Leonard Bruckman testified for the defense.
